This Privacy Notice describes how the European AV Group GmbH (subsequently "EAV Group") processes and protects the data you provide when using our website according to the General Data Protection Regulation (GDPR) and the relevant German data protection laws, particularly the German Federal Data Protection Act (BDSG).

The security of personal data such as name, address, telephone number or email is a serious and important concern for our company. Personal data / types of use

Protecting your data is of the highest priority for the EAV Group. You decide whether you wish to make such data known to us during any registration, survey, or the like. Such information on your part is relevant for your enquiry, but you always provide it voluntarily. An exception to this rule is when practical reasons cannot obtain prior consent, and the law permits data processing.

Legal basis for the processing of personal data

If we obtain the subject's consent to process their data, Article 6(1)(a) GDPR serves as the legal basis for processing personal data.

When processing personal data necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) GDPR shall serve as the legal basis. It also applies to any processing required to perform pre-contractual measures.

If the processing of personal data is necessary for compliance with a legal obligation to which EAV Group is subject, Article 6(1)(c) GDPR shall serve as the legal basis.

If the vital interests of the data subject or another natural person necessitate the processing of personal data, Article 6 (1)(d) GDPR shall serve as the legal basis.

If processing is necessary to safeguard the legitimate interests of our company or a third party, except where such interests get overridden by the interests or fundamental rights and freedoms of the data subject, Article 6(1)(f) GDPR shall serve as the legal basis for processing.

Data deletion and storage duration

The data subject's data will be deleted or blocked as soon as the purpose of storage ceases to apply. Data may get stored beyond this point if provisions have been made for this by the European or national legislator in Union regulations, laws, or other rules to which the controller is subject. Data will also be blocked or deleted if a storage period prescribed by the standards mentioned above expires unless there is a need for further data storage for the conclusion or fulfilment of a contract.

Data automatically collected on our website / usage data

We welcome anybody to visit and use our website free of charge and look at the services we offer. When you visit our website, we record the following general usage data to assess which parts of our website you visit and how long you stay there:

  • Information about the browser type and version used

  • The user’s operating system

  • The user’s IP address

  • Date and time of access

  • Websites from which the user’ system reaches our website

  • The services and functions used on our website

The record holds a combination of all visitors' usage data to measure i.E. the number of visitors, the average time of the visits, or the pages visited. The data we collect is combined and used for internal purposes only.
The legal basis for the temporary storage of data and log files is Article 6(1)(f) GDPR.

We use this combined data for evaluating our products, services, and the news we make available via our website, as well as for monitoring the use of our website and generally improving its content.

The temporary storage of IP addresses by the system is required to enable the delivery of the website to the user's computer. The user's IP address gets stored for the session's duration to obtain a complete delivery of the website.

Data is stored in log files to ensure the functionality of the website. In addition, we use the data to optimise the website and to ensure the security of our information technology systems. These purposes are also the basis for our legitimate interests in data processing according to Article 6(1)(f) GDPR.

The data gets deleted as soon as it is no longer necessary for its collection. This process would take effect after no more than seven days if data got stored in log files. Further storage is possible. In this case, the users' IP addresses are deleted or distorted, so it is no longer possible to associate them with the calling client.

Collecting data to provide the website and storing the data in log files is essential for the website's operation. Therefore, the user cannot opt-out.

We have no control over the data collected either voluntarily or involuntarily via advertisements or websites of third parties. Third-party advertisements or links to other websites displayed on our website may collect user data if you click on them or otherwise follow their instructions. We recommend that you read the privacy policies of the promoted websites if you have any concerns regarding the collection and use of your data.

Cookies

Like many other commercial websites, EAV Group sometimes uses the technology known as "cookies" to collect information on how you use the website and ensure your visit runs smoothly.

Tracking / web bugs

Some of our services also use "tracking bugs", "web bugs", or "tracking pixels". They include code snippets that are usually only 1x1 pixel in size and can identify and detect your browser via the browser ID – your browser's individual "fingerprint". It enables the service provider to track user behaviour on email and website usage.

You can use tools such as webwasher, bugnosys and AdBlock to prevent web bugs on our website. Without your consent, we will not use web bugs to secretly collect your data or share such data with third parties and marketing platforms.

Purposes of and legal basis for the use of cookies and other identifiers

The legal basis for personal data processing using technically necessary cookies is Article 6(1)(1)(f) GDPR.

The purpose of using technically essential cookies is to facilitate the use of websites for users. Some features of our website do not run smoothly without cookies. Recognising the browser for these features is necessary, even after moving to a different page.

The right to object is excluded for technically essential cookies as these are required to display the website and its contents and make its functionalities available.

Web fonts and icons

EAV Group's website uses web fonts and icons provided by Google and FontAwasome for a uniform display of fonts. When you call up a page, the browser loads the necessary data into your browser cache to display texts and fonts correctly. Therefore, the browser connects with Google or FontAwesome servers to process and provide information that the website gained accessed via your IP address.

Subscription to our newsletter

A data subject can subscribe to a corporate newsletter on EAV Group's website. The input mask used for the purpose specifies the data submitted by the data subject.

EAV Group frequently informs its customers and business partners about corporate news and events through a newsletter service. A data subject may only receive our newsletter if:

1. the data subject has a valid email address

2. the data subject registers to receive our newsletter. The data subject must confirm its submission using a double-opt-in procedure that verifies the submitted data's validity.

When registering, we store the IP address of the computer system used at the submission time and the registration date assigned by the Internet service provider (ISP). The data collection is necessary to trace the (possible) misuse of an email address at a later point in time and therefore serves as a legal safeguard for the controller.

The personal data collected is used exclusively for the newsletter dispatch. Furthermore, new subscribers get informed by email if this is necessary for the operation of the newsletter service or a related registration, as could be the case in the event of changes to the newsletter offer or changes in the technical circumstances. No personal data collected as part of the newsletter service will get passed on to third parties. The consent to the storage of personal data, which a data subject has submitted, can be revoked at any time. Cancellation of a subscription is possible at any time. We always indicate a corresponding link to cancel a subscription on each dispatched newsletter.

Newsletter tracking

The EAV Group newsletters do not contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails that are sent in HTML format to enable log file recording and log file analysis. It allows a study which indicates the success or failure of online marketing campaigns. Based on the embedded tracking pixel, EAV Group may see if and when a data subject opened an email and links the data subject called up in the email.

Such personal data collected via the tracking pixel contained in the newsletters are stored and analysed by the controller to optimise the newsletter dispatch and better tailor future newsletters' content to a data subject's interests. The personal data will not get disclosed to third parties. The data subject is entitled to revoke the separate declaration of consent given in this regard via the double-opt-in procedure. After a revocation, the data controller will delete this personal data. EAV Group automatically regards a withdrawal from the receipt of the newsletter as a revocation.

Contact possibility via the website

Based on statutory provisions, EAV Group website contains information that enables a quick electronic contact with our enterprise and direct communication with us, including a general address of the so-called electronic mail (email address). Personal data transmitted voluntarily by a data subject to the controller will be stored for processing or contacting the subject of the data. If a person affected contacts the controller by email or using a contact form, the personal data transmitted by the data subject would be stored automatically. Personal data will not get disclosed to third parties.

Use of services for marketing and analysis purposes

Google Analytics

Our website uses Google Analytics, a web analytics tool by Google Inc. ("Google"). Google Analytics uses "cookies", text files stored on your computer that enable an analysis of how you use the website. The cookie-generated information about website interactions is usually transmitted to and stored on a Google server in the United States. Google will use this information on our behalf to analyse how you use the website, compile reports on website activity and provide further services related to website and internet use to the website operator. Google Tag Manager

We use Google Tag Manager to manage "website tags". Tags are small code elements on our website that run upon specific interactions with the website and send measured data to the third-party programs (e.g. Google Analytics). The Tag Manager triggers other tags that collect data and place cookies under certain circumstances (e.g., the third-party programs used). The Tag Manager does not access this data. The Tag Manager itself does not use cookies and does not collect any personal data.

Embedding and using links to social media (LinkedIn, Youtube, Instagram, or the like)

We embed links to external social network services such as LinkedIn or YouTube on our website. The responsibility for the internet services of these social network services lies solely with their operators. Below you will find further information, categorised according to the corresponding social network service.

None of your data gets transferred to social media services due to our links to these services. These are normal hyperlinks through which no regular data transmission takes place. Data is only transmitted if you log in to your user account of the corresponding social media service before interacting with our website. If you click the link on our website, you will be taken directly to our social media page on the respective social media service. You can then link to or share content from our websites using the social media service or watch the videos on our YouTube channel. Under certain circumstances, the social media service may thus ascertain which content you have viewed on our website.

Embedded YouTube videos

When you visit a website which embeds YouTube videos, Google receives information that you have accessed this website. The data mentioned in the above section ("usage data") is also transmitted. That happens regardless of whether Google provides an existing or inexistent user account. If logged in to your Google account, your data will be directly associated with your account. If you do not wish data to be associated with your Google profile, you must log out before visiting websites that embed YouTube videos.

Google stores this data as a user profile and uses it for advertising, market research and or demand-led configuration of its website. The legal basis for the use of YouTube videos on our website is our legitimate interest (Article 6(1)(1)(f) GDPR) in the demand-oriented, visually optimised presentation of our website, above all through the use of videos.

Right to object

Rights as a data subject

1. Information, rectification, restriction, and deletion

You have the right to access the data stored about you by EAV Group and information concerning its origin and recipient and the purpose of data processing by EAV Group websites free of charge at any time. In addition, you have the right to rectify, delete or restrict the processing of your data, provided the legal requirements to do so are met.

2. Right to data portability

You have the right to receive the personal data concerning you that you have provided to EAV Group as the controller in a structured, commonly used and machine-readable format. EAV Group can comply with this right by providing a CSV export of the customer data processed about you.

3. Right to information

Suppose you have asserted the right to rectify, delete or restrict processing against the controller. The latter is obliged to communicate this rectification, deletion of the data or restriction of processing to all recipients unless this proves impossible or involves a disproportionate effort.

4. Right to object

You have the right to object, on grounds relating to your situation, at any time to the processing of your data based upon point (e) or (f) of Article 6(1) GDPR, including profiling based upon those provisions.

The controller shall no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing that override your interests, rights, and freedoms or for the establishment, exercise or defence of legal claims.

Where your data gets processed for direct marketing purposes, you have the right to object to the processing of personal data concerning you for such marketing, including profiling to the extent that it is related to such direct marketing. Your objection will no longer process your data for such purposes.

In the context of using information society services, and notwithstanding Directive 2002/58/EC, you may exercise your right to object by automated means using technical specifications.

5. Revocability of declarations of consent under the data protection law

You may also revoke your consent concerning EAV Group at any time with effect for the future using the contact details given below.

6. Right to file a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to file a complaint with a supervisory authority in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
